These terms of use govern access to and use of the Mini ClockGuru Application during the period covered by a paid license.
Access to the Application requires prior, express and full acceptance of these terms. To that end, the user must read the terms and give consent by checking the box provided before buying a license or accessing the Application. Without such acceptance, access to the Application is not authorized.
The Privacy Policy separately describes how personal information is handled and is accepted separately.
Mini ClockGuru is a visual tool that helps a child see time passing and follow a schedule, a routine or the steps of a task. It is a support tool.
Mini ClockGuru is not a medical device, a treatment, or a monitoring or safety service. It does not replace adult supervision or the advice of a health or education professional.
The Application is designed to be set up and managed by an adult (parent, guardian, teacher, support worker). The adult is responsible for the accuracy and relevance of the schedules and content entered, and for the authorizations needed to use information or images about other people or children. A child may view the schedules prepared by the adult, under appropriate supervision. The user must not collect, enter or disclose personal information about a child without the legally required authorizations.
There is no free trial. Before buying, the user can watch, free of charge on the Application's first screen, a short presentation (about 2 minutes) and a full presentation (about 8 minutes) of Mini ClockGuru. The user also has the 15-day right of withdrawal described in section 7.2.
Subject to payment of the applicable price and compliance with these terms, a license grants a limited, non-exclusive, non-transferable and non-assignable right to use the Application for twelve (12) months, for the personal, family or professional purposes announced at the time of purchase. The license may be used on all the devices of one family or one classroom.
The twelve-month period starts on the date of purchase. When a new license is bought with the same email address before the current license ends, it starts when the current one ends, so no days are lost.
This is not a transfer of intellectual property. The license does not renew automatically: a new license must be bought to keep using the Application after twelve (12) months. The license key must not be published, resold or given to unauthorized persons, in particular outside the user's family or classroom.
The license costs CA$29.99 per year (US$21.99 in the United States), plus taxes. In other countries, the checkout page may show the amount in the local currency. The price, applicable taxes and payment terms are shown before the purchase is completed.
Payments are processed by Stripe, which acts as the merchant of record of the transaction (under the name "Link"), according to the terms shown at the time of the transaction. The Operator provides the Application, the license key and user support.
Every buyer, wherever they live, may withdraw and get a full refund within fifteen (15) days of purchase, without giving any reason, even after starting to use the Application.
To exercise this right, the buyer sends a clear statement of the decision to contact@miniclockguru.com, preferably from the email address used for the purchase, before the period ends.
The refund is made within fourteen (14) days of receiving the request, using the same payment method as the purchase, unless the buyer expressly agrees otherwise, and at no cost to the buyer. The refunded license key then stops working. The schedules stay on the user's device.
After this period, licenses are not refundable for a simple change of mind, subject to the rights and remedies provided by applicable laws.
The fifteen-day period in section 7.2 includes and exceeds the fourteen-day withdrawal period under European Union law. Mini ClockGuru does not apply the exceptions to the right of withdrawal for digital content (Article 16 of Directive 2011/83/EU): starting to use the Application does not cancel the right of withdrawal during these fifteen (15) days.
Nothing in this section excludes or limits the mandatory rights the user has under applicable laws, including legal warranties and rights of cancellation, withdrawal or refund.
The Application runs in a web browser and depends on the device, its power, its connection, its settings, the browser and the restrictions of the operating system.
Sounds, announcements, bells and alarms may not play, in particular when the device is locked, turned off, out of battery, offline, or when the Application is not active on the screen.
Never use Mini ClockGuru as the only reminder for a situation where something missed or late could endanger a person, harm their health or have serious consequences, such as taking medication, safety, or an essential appointment.
Schedules are kept on the user's device. Once the license is activated, a copy is also kept online so the Application can be used on other devices.
Photos added to activities are kept only on the device where they were added. They are not copied online during sync. They leave the device only if the user chooses to include them in a file the user creates with "Export schedule" or "Share as one file".
The user is responsible for keeping the backups they need, for example with "Export schedule", and agrees to use and share only photos and other content for which they hold the necessary rights and permissions.
Personal information is handled according to the Privacy Policy, which describes the categories of data, purposes, providers, hosting locations, retention periods and how to exercise your rights.
Unless expressly permitted by law or authorized in writing, it is prohibited to: (a) copy, redistribute, sell, sublicense or commercialize the Application or its protected elements; (b) get around its license or security mechanisms; (c) access accounts or data without authorization; (d) use the Application unlawfully or in a way that violates the rights of others. These restrictions do not apply to content owned by the user or to acts permitted by mandatory legal provisions.
Subject to elements belonging to third parties or used under separate licenses, the intellectual property rights in the Application, its presentation, texts and graphics remain the property of their respective owners. Some elements, such as some of the icons, were created by other authors and are used with their permission; their names and licences are listed in the User's Guide. The user keeps the rights they hold in their own schedules, photos and other content, and grants only the technical permissions needed to provide the services they choose to use, subject to the Privacy Policy.
We make reasonable efforts to keep the Application running and maintained, but occasional interruptions may occur. Fixes, updates or adaptations may be made, in particular for security or compatibility. During a paid license, we will not remove without valid reason an essential feature expressly included in the offer at the time of purchase. When an important change affects the agreed service, the rights and remedies provided by law remain fully preserved.
To the extent permitted by law, the Application is provided "as is", and our total liability is limited to the amount you paid for the current license. Nothing in these terms excludes or restricts the legal warranties, rights or remedies the user cannot validly waive, including those under Quebec's Consumer Protection Act or the applicable law of the European Union.
You may stop using the Application at any time. "Delete my cloud data" (Settings → Backup) lets you delete your data as described in the Privacy Policy. In case of a serious breach of these terms, we may take proportionate measures, including suspending or ending access, after notice and a reasonable opportunity to remedy the breach when circumstances allow. The user's mandatory rights and remedies are preserved.
The current version and its date are available in the Application and on the website. Any important change will be announced in advance by appropriate means. A change cannot remove an acquired right or unilaterally change a contract in progress contrary to the applicable rules, in particular those protecting consumers.
Subject to applicable mandatory provisions, these terms are governed by the laws in force in Quebec and the federal laws of Canada that apply there. They do not deprive consumers of the mandatory protections of the place where they live, when those apply. The terms are written in French; this English version is provided for convenience. In case of difference, the French version prevails, to the extent permitted by law.
